Appealing A Conviction

Every person has the right to appeal a conviction or sentence imposed by any court in Western Australia. A successful appeal requires identifying and articulating an error in fact or law.

Our team of lawyers at Legal Pathways will examine the evidentiary and legal aspects of your appeal and will consult and engage an appellant barrister who will determine firstly whether there are any grounds of appeal and secondly whether there are reasonable prospects of success. If there are reasonable prospects of success we will prepare the appeal in conjunction with an appellant barrister and take your matter back to court.

Your right to appeal is time restricted (generally 21 days after conviction or sentence) therefore if you wish to appeal your conviction or sentence please contact one of our lawyers as soon as possible.
